General terms and conditions for Bay Retreat Port Arthur

Throughout this website the terms we, our or us refers to the owners of Bay Retreat Port Arthur and its agents.
CONDITIONS OF SALE
Bay Retreat accommodation may only be purchased on line through Bay Retreat Port Arthur (http://www.bayretreat.com.au) By booking on our website you accept and are bound by the following terms and conditions. Purchasers must be over eighteen (18) years of age and must agree to purchase accommodation in Australian dollars or at the prevailing international exchange rate at the time of purchase.
Bay Retreat is not responsible or liable for fluctuations in international monetary exchange rates.
By placing a booking with us you also accept that there is to be no pets or smoking allowed for the duration of your stay.
PURCHASE OF ACCOMMODATION
Accommodation may only be purchased by credit card, debit card; either MasterCard, Visa or PayPal.There is a $30 booking fee charged. You must be the owner/ holder of the credit card or direct deposit account holder used for your accommodation purchase. When booking on bayretreat.com.au your electronic instructions are binding and will be processed on your payment by credit card. A booking confirmation of reservation email will automatically be generated and sent to the email address nominated by you during your booking. If this email is not received by you within 3 hours of your payment it is your responsibility to contact us.
ACCESS CODE
Access to Bay Retreat may ONLY be gained by use of the electronic key pad situated at the front door. Your personal 5 digit code followed by the # key will allow entry to the premises for five (5) seconds.
Your 5 digit personal access code will be your mobile phone number using 2nd to 6th digits plus #.
(Example only mobile number 0425 721 955 ACCESS CODE 42572#) IF YOU HAVE NOT USED A MOBILE PHONE NUMBER ON YOUR ORIGINAL BOOKING WE WILL EMAIL YOU AN ACCESS CODE FOR YOUR STAY.
It is your only means of accessing your accommodation during your stay.
This code MUST be used EACH time you need to open the door. Enter your code plus # and immediately push the door to open.
On leaving the premises the security can be armed by pushing the arming button on the inside of the door. You only have 30 seconds exit time once armed.
Your code will not operate before 2 p.m. on the day of checking in and not after 10 a.m. on your day of departure.
THE PREMISES MUST BE VACATED BY 10 a.m. ON DAY OF DEPARTURE AS THE CARETAKER WILL ACCESS THE PROPERTY FOR CLEANING AT THAT TIME. NO EXCEPTIONS.
It is your responsibility and that of other members of your group to ensure that this code is not divulged to any unauthorised person or party. Bay Retreat will not be liable in any way for losses incurred by any member of your party, if this code is divulged to any unauthorised person, persons or party.
Please ensure that this code is not lost or forgotten otherwise you will be unable to enter Bay Retreat at any time during your stay.
BEDDING OPTIONS
PLEASE READ BEDDING OPTIONS AND CHARGES CAREFULLY
Each bedroom will be deemed to be occupied by 2 persons so if you require a bedroom for ONE you need to book for TWO persons
NUMBER OF ROOMS = 1 as we are one bookable house. ROOMS DOES NOT MEAN BEDROOMS.
YOU WILL BE THE SOLE OCCUPANTS OF BAY RETREAT PORT ARTHUR - YOU WILL NOT BE SHARING WITH ANYONE ELSE.
IF YOU REQUIRE A PARTICULAR BEDDING CONFIGURATION FOR YOUR BOOKING YOU NEED TO EMAIL info@bayretreat.com.au TO ARRANGE.
CANCELLATIONS
If a cancellation is made thirty (30) days prior to your booking date/s a $100 dollars cancellation fee is incurred. The balance will be refunded to you. If however the cancellation is made less than thirty (30) days prior to the booked date you will forfeit the full purchase price.
NO SHOWS
If you fail to utilise the whole or part there of your booking at Bay Retreat we are not obliged to refund the purchase price in whole or part.
PROPERTY DAMAGE, LOSS,THEFT AND EXTRA CLEANING CHARGE
Bay Retreat keeps a full record of all property and its condition before and after bookings. Any loss, damage, theft or extra cleaning required due to the condition the place is left in, caused by you or any members of the party will be billed via your credit card or other means regardless of how the loss, damage or extra cleaning requirements occurred and including any cost of repairs and replacement. Details of the damage, loss or extra cleaning $60 (cleaning minimum charge) incurred and cost of repairs or cleaning will be emailed to you including the amount charged to you via your chosen form of payment. By booking you agree to pay via your credit card or PayPal for such losses or extra cleaning charge, and your details will be kept by a secure third party provider for such a purpose. If our loss or damage necessitate an insurance claim you will be liable to pay for the excess insurance payment. If reimbursement is not made within four (4) weeks of our demand you will be liable for an interest rate charge of 18% per annum on the outstanding amount.
PRIVACY AND SECURITY INFORMATION
Bay Retreat uses a secure third party server and payment system to safeguard all information concerning your booking. We understand your privacy concerns and undertake not to share your personal details with any other organisation without your consent.
SAFETY
Bay Retreat is bounded by the sea front and a road. The property is entirely fenced but it is essential that parents supervise children at all times for their safety. You agree that we will not be held liable in any way for any injuries incurred by you or any members of your group whilst staying at Bay Retreat.
Please note our bush setting means insects such as inchman and jack jumper ants could be present, if you have allergies to such insects or any other that you may come in contact with whilst visiting Bay Retreat please take appropriate precautions.
SECURITY
When checking out of Bay Retreat at the end of your stay you must ensure that all windows and the door is locked before you leave. This is also necessary when you leave the property during your stay. You will be held liable for any damage or loss as a result of your failure to properly secure the property and activate the alarm system.
Disabled facilities are NOT provided.
ANIMALS
Animals are not permitted, except for Guide Dogs.
THIRD PARTY
Someone booking for you, travel agents etc
Third parties are prohibited from divulging any customer information. These persons, parties or organisations must abide by the terms and conditions of this web site. Third parties will be held responsible for any losses caused by the unauthorised disclosure of information including access codes and credit / debit card information.
INDEMNITY
You indemnify and hold harmless Bay Retreat Port Arthur for any loss you may incur as a result of your breach of the Terms and Conditions of our website.
Bay Retreat Port Arthur accepts no liability whatsoever, whether implied or otherwise and you agree to hold harmless, absolve and indemnify Bay Retreat Port Arthur from any responsibility, liability, damages, claims or expenses at all (including but not limited to legal costs), arising from any loss or injury suffered by you or any person in your traveling party, as a result of your use of the property.
LEGAL
Should any clause or part thereof of these Terms and Conditions be found to be void, unenforceable or invalid, then it is severed from this agreement, leaving the remainder in full force and effect, provided that the severance has not altered the basic nature of this agreement.
